Fijn dat je meedoet. Deze voorwaarden beschrijven de inschrijving, annulering, veiligheid en het gebruik van beeldmateriaal, zodat op de dag zelf de aandacht bij het maken kan liggen. Onder deelnemer verstaan we de fotograaf, videograaf of content creator die zich inschrijft, voor zover de workshop voor die discipline is opengesteld. Alle bedragen in deze voorwaarden en in de workshopbeschrijving zijn inclusief btw.

Onderdeel 01 Inschrijving en betaling

1. De inschrijving is definitief zodra Wild Heart Tales het volledig ingevulde formulier en de reserveringsbetaling heeft ontvangen. Je bent achttien jaar of ouder en geeft op het formulier aan of je als particulier of als bedrijf boekt.
2. De reserveringsbetaling is onderdeel van de totale workshopprijs en staat vermeld in de workshopbeschrijving. Het resterende bedrag wordt uiterlijk zeven kalenderdagen voor de workshop betaald. Bij inschrijving binnen zeven dagen is de volledige workshopprijs direct verschuldigd.
3. Betaal je niet op tijd, dan ontvang je een herinnering met een betaaltermijn van zeven dagen. Blijft betaling daarna uit, dan mag Wild Heart Tales de inschrijving annuleren en de plek opnieuw aanbieden. De annulering geldt dan als een annulering door de deelnemer op die datum, volgens onderdeel 02.
4. De inschrijving is persoonlijk. Wil je je plek overdragen, dan kan dat volgens de regeling voor vervangers in onderdeel 02.
5. De workshopbeschrijving, het inschrijfformulier en deze voorwaarden vormen samen de overeenkomst. Wijken zij van elkaar af, dan gaat de workshopbeschrijving voor. De versie van deze voorwaarden die je bij je inschrijving hebt geaccepteerd, geldt voor jouw deelname.
6. Alle termijnen in deze voorwaarden worden gerekend in kalenderdagen vóór de dag van de workshop.

Onderdeel 02 Annulering door de deelnemer

De administratiekosten worden alleen verrekend met een daadwerkelijke terugbetaling; het terug te betalen bedrag is nooit lager dan €0. Terugbetalingen doen we binnen veertien dagen.

Kun je niet komen, meld dit dan zo snel mogelijk schriftelijk via hello@wildhearttales.com. We begrijpen dat er van alles tussen kan komen. Omdat we ruim vooraf kosten maken voor modellen, locatie en leveranciers, geldt deze regeling ook bij ziekte, vervoersproblemen of andere persoonlijke omstandigheden. Een annuleringsverzekering kan hierbij helpen.

Je mag altijd zelf een vervanger regelen; dat kost je niets extra. Meld de vervanger uiterlijk 48 uur voor de workshop. De vervanging is definitief na schriftelijke goedkeuring door Wild Heart Tales, een volledig ingevuld formulier en akkoord met deze voorwaarden. De deelnemer en de vervanger verrekenen eerder betaalde bedragen onderling.

Onderdeel 03 Doorgang, annulering of wijziging door Wild Heart Tales

1. Een workshop gaat door bij minimaal twee deelnemers. Wordt dat aantal niet bereikt, dan kan Wild Heart Tales de workshop annuleren of verplaatsen. Je hoort zo snel mogelijk of de workshop definitief doorgaat, en uiterlijk zeven kalenderdagen voor de workshop.
2. Annuleert Wild Heart Tales de workshop, om welke reden dan ook, dus ook bij ziekte, onveilige weersomstandigheden, verlies van de locatie, een overheidsmaatregel of andere overmacht, dan worden alle ontvangen betalingen binnen veertien dagen volledig terugbetaald, zonder administratiekosten. Dat geldt ook wanneer je het resterende bedrag al had voldaan.
3. Bij verplaatsing kies je binnen veertien dagen na ons bericht tussen de nieuwe datum of volledige terugbetaling. Horen we niets van je, dan gaan we uit van de nieuwe datum.
4. Redelijke wijzigingen in planning, styling, modellen, leveranciers of een nabijgelegen shootlocatie geven geen recht op terugbetaling, zolang karakter en kwaliteitsniveau van de workshop in grote lijnen gelijk blijven.
5. Boek reis en verblijf bij voorkeur pas na de definitieve bevestiging. Zelf geboekte reis- en verblijfskosten, kinderopvang, gemiste opdrachten en andere gevolgkosten worden niet vergoed. Ook hier kan een annuleringsverzekering uitkomst bieden.

Onderdeel 04 Deelname, veiligheid en respect

1. Je volgt redelijke aanwijzingen van Wild Heart Tales en behandelt de modellen, leveranciers, andere beeldmakers, omstanders, locatie en natuur met respect.
2. Een model wordt niet zonder toestemming aangeraakt. Kleding, haar, accessoires en persoonlijke eigendommen worden alleen na toestemming aangepast of verplaatst.
3. Je blijft binnen toegestane gebieden en volgt de regels van de locatie of het natuurgebied.
4. Bij onveilig, discriminerend, intimiderend of seksueel ongepast gedrag kan je deelname direct worden beëindigd. Bij minder ernstig storend gedrag krijg je eerst een waarschuwing. De beslissing ligt bij Wild Heart Tales. Bij beëindiging vindt geen terugbetaling plaats en zorg je zelf voor je vervoer. Beeldmateriaal dat je tot dat moment hebt gemaakt, mag je gebruiken volgens de onderdelen 05 en 06.
5. Je bent zelf verantwoordelijk voor apparatuur, persoonlijke eigendommen, vervoer en verzekeringen. Een aansprakelijkheids- en apparatuurverzekering wordt aangeraden.
6. Schade die je verwijtbaar veroorzaakt aan de locatie, aan apparatuur of aan eigendommen van anderen, komt voor eigen rekening.
7. De workshop is een creatieve en educatieve ervaring. Specifiek weer, licht, bloei, poses, beelden of portfolioresultaten kunnen niet worden gegarandeerd.

Onderdeel 05 Wat je met je beeldmateriaal mag doen

Je maakt tijdens de workshop je eigen werk; het auteursrecht blijft bij jou. Onder beeldmateriaal vallen foto's, video's en herkenbare behind-the-scenesbeelden die je binnen de afgesproken workshopsetting maakt.

1. Gebruik voor je eigen website, blog, portfolio en social media.
2. Gebruik in gedrukte portfolio's, samplealbums en eigen professionele promotie, online en offline.
3. Vermeld bij publicatie Wild Heart Tales, de modellen en de betrokken leveranciers.
4. Wild Heart Tales zorgt ervoor dat de modellen vooraf schriftelijk toestemming geven voor het gebruik van hun portret zoals hierboven beschreven, en regelt waar nodig toestemming van de locatie. Trekt een model die toestemming later in of maakt een model bezwaar tegen een bepaalde publicatie, dan laten we je dat zo snel mogelijk weten en kijken we samen wat dat betekent voor toekomstig gebruik. Beeldmateriaal dat al is gepubliceerd of gedrukt, hoef je niet te verwijderen, tenzij dat wettelijk verplicht is.

Onderdeel 06 Wat je niet met je beeldmateriaal mag doen

Deze afspraken beschermen de modellen, de leveranciers en het hele team dat aan de shoot heeft meegewerkt.

1. Verkoop, doorlicentiëring, stockgebruik of overdracht aan bedrijven of merken die niet bij de shoot betrokken waren.
2. Inzending voor wedstrijden, awards, fotocompetities of jurybeoordelingen. Veel wedstrijden vragen exclusiviteit of rechten op het beeld, en één inzending kan de kansen van het hele team blokkeren.
3. Publicatie door tijdschriften, blogs of andere redactionele media zonder voorafgaande schriftelijke toestemming van Wild Heart Tales. Vraag het gerust: we werken graag mee aan publicatie en regelen dan ook de toestemming van de modellen en leveranciers.
4. Gebruik in een politieke, medische, seksuele, vernederende, discriminerende of misleidende context.
5. Presenteren als een echte bruiloft, of als een volledig zelf geproduceerde styled shoot.

Onderdeel 07 Beeldmateriaal delen na de workshop

1. Het is fijn als je binnen acht weken minimaal vijf bewerkte beelden deelt met Wild Heart Tales, de modellen en de betrokken leveranciers. Dit is een verzoek en geen voorwaarde voor deelname; RAW-bestanden hoeven niet te worden aangeleverd.
2. Deel je beelden, dan geef je Wild Heart Tales, de afgebeelde modellen en de leveranciers uit de creditlijst het recht om die beelden te gebruiken voor hun eigen portfolio, website, social media en promotie van de workshop of hun eigen bijdrage. Je naam wordt daarbij vermeld.
3. Je kunt dit gebruiksrecht op elk moment schriftelijk beëindigen voor nieuw gebruik. Beeldmateriaal dat al is gepubliceerd of gedrukt, hoeft niet te worden verwijderd.
4. Wild Heart Tales, de modellen en de leveranciers verkopen jouw beelden niet, licentiëren ze niet door, zenden ze niet in voor wedstrijden en dragen ze niet over aan bedrijven of merken die niet bij de shoot betrokken waren.
5. Publiceer je zelf beelden op social media, dan mogen Wild Heart Tales, de modellen en de leveranciers die berichten delen of opnieuw plaatsen met naamsvermelding. Wil je dat liever niet, laat het dan even weten.

Onderdeel 08 Onjuist beeldgebruik en herstel

1. Gebruik je beeldmateriaal in strijd met onderdeel 05 of 06, dan vragen we je eerst schriftelijk om het gebruik binnen zeven dagen te stoppen, te verwijderen of een inzending in te trekken. Doe je dat, dan heeft de fout geen verdere gevolgen.
2. Werk je aantoonbaar mee, maar kan een gebruik feitelijk niet meer worden teruggedraaid, bijvoorbeeld omdat een tijdschrift al is gedrukt, dan is evenmin een boete verschuldigd.
3. Stop je het gebruik niet en reageer je niet op onze schriftelijke aanmaning, dan is een boete verschuldigd van €250 per ongeoorloofd gebruik, met een maximum van €750 per deelnemer per workshop. Deze boete komt in de plaats van schadevergoeding.

Onderdeel 09 Behind the scenes, privacy en communicatie

1. Op het inschrijfformulier geef je apart aan of herkenbare behind-the-scenesfoto's en video's van jou voor promotie gebruikt mogen worden. Deze keuze heeft geen invloed op je deelname en je kunt je toestemming op elk moment intrekken via hello@wildhearttales.com. We gebruiken de beelden dan niet opnieuw; materiaal dat al is gedrukt of gepubliceerd, kan niet altijd worden teruggehaald.
2. Respecteer ook de keuze van andere deelnemers: publiceer geen herkenbare beelden van een mededeelnemer zonder diens toestemming.
3. Je persoonsgegevens worden gebruikt voor inschrijving, betaling, facturatie en communicatie over de workshop. Je hebt recht op inzage, correctie, verwijdering van en bezwaar tegen het gebruik van je gegevens, en je kunt een klacht indienen bij de Autoriteit Persoonsgegevens. Welke gegevens we bewaren en hoe lang, lees je in de privacyverklaring.
4. Een tijdelijke WhatsApp-groep wordt alleen gebruikt wanneer je daarvoor kiest en uitsluitend voor praktische informatie over de betreffende workshop. In de groep zijn je telefoonnummer en profielnaam zichtbaar voor de andere deelnemers. De groep wordt uiterlijk twee weken na de workshop verwijderd.

Onderdeel 10 Aansprakelijkheid, klachten en recht

1. Wild Heart Tales is niet aansprakelijk voor verlies, diefstal of beschadiging van apparatuur en persoonlijke eigendommen, behalve bij opzet of bewuste roekeloosheid.
2. Voor zover wettelijk toegestaan is de aansprakelijkheid beperkt tot het bedrag dat je voor de workshop hebt betaald. Deze beperking geldt niet bij overlijden of lichamelijk letsel. Indirecte schade, zoals gemiste opdrachten of reis- en verblijfskosten, wordt niet vergoed.
3. De workshop is een dienst op het gebied van vrijetijdsbesteding die op een vooraf afgesproken datum wordt verricht. Het wettelijke herroepingsrecht van veertien dagen voor overeenkomsten op afstand is daarom niet van toepassing (artikel 6:230p onder e BW).
4. Heb je een klacht, laat het ons dan zo snel mogelijk weten, en uiterlijk binnen twee maanden na de workshop, schriftelijk via hello@wildhearttales.com. Je ontvangt binnen veertien dagen een inhoudelijke reactie, zodat we samen tot een oplossing kunnen komen.
5. Is een bepaling van deze voorwaarden nietig of vernietigbaar, dan blijven de overige bepalingen gelden en vervangen we die bepaling door een geldige bepaling die zo dicht mogelijk bij de bedoeling ervan blijft.
6. Op de inschrijving en deelname is Nederlands recht van toepassing. Een geschil bespreken we eerst onderling; lukt dat niet, dan wordt het voorgelegd aan de bevoegde Nederlandse rechter. Woon je als particulier in een ander EU-land, dan behoud je de bescherming van het dwingende recht van je eigen land. Rechten die wettelijk niet kunnen worden uitgesloten, blijven altijd gelden.

Lovely that you are joining. These terms describe registration, cancellation, safety and the use of images, so that on the day itself the attention can be on making work. By participant we mean the photographer, videographer or content creator who registers, insofar as the workshop is open to that discipline. All amounts in these terms and in the workshop description include VAT.

Section 01 Registration and Payment

1. Your registration is final once Wild Heart Tales has received the fully completed form and the reservation payment. You are eighteen or older and state on the form whether you are booking as a private individual or as a business.
2. The reservation payment is part of the total workshop price and is stated in the workshop description. The remaining amount is paid no later than seven calendar days before the workshop. If you register within seven days, the full workshop price is due immediately.
3. If you do not pay on time, you will receive a reminder with a payment term of seven days. If payment is still not made, Wild Heart Tales may cancel the registration and offer the place again. That cancellation then counts as a cancellation by the participant on that date, under section 02.
4. Registration is personal. If you want to transfer your place, that is possible under the substitute arrangement in section 02.
5. The workshop description, the registration form and these terms together form the agreement. If they differ from one another, the workshop description prevails. The version of these terms you accepted at registration applies to your participation.
6. All periods in these terms are counted in calendar days before the day of the workshop.

Section 02 Cancellation by the Participant

Administration costs are only deducted from an actual refund; the amount to be refunded is never less than €0. Refunds are made within fourteen days.

If you cannot come, please let us know in writing as soon as possible at hello@wildhearttales.com. We understand that things come up. Because we incur costs well in advance for models, location and suppliers, this arrangement also applies in the event of illness, transport problems or other personal circumstances. Cancellation insurance can help here.

You may always arrange a substitute yourself; that costs you nothing extra. Report the substitute no later than 48 hours before the workshop. The substitution is final after written approval by Wild Heart Tales, a fully completed form and agreement with these terms. The participant and the substitute settle any amounts already paid between themselves.

Section 03 Going Ahead, Cancellation or Changes by Wild Heart Tales

1. A workshop goes ahead with a minimum of two participants. If that number is not reached, Wild Heart Tales may cancel or reschedule the workshop. You will hear as soon as possible whether the workshop is definitely going ahead, and no later than seven calendar days before the workshop.
2. If Wild Heart Tales cancels the workshop, for whatever reason, including illness, unsafe weather conditions, loss of the location, a government measure or other force majeure, all payments received are refunded in full within fourteen days, without administration costs. This also applies if you had already paid the remaining amount.
3. In the event of rescheduling, you choose within fourteen days of our notice between the new date or a full refund. If we do not hear from you, we assume the new date.
4. If the workshop cannot be completed on the day itself, for example because of sudden unsafe weather or an incident, we will look for a suitable solution together: completing it at another time, or a refund of the part that was not carried out.
5. Reasonable changes to the schedule, styling, models, suppliers or a nearby shoot location do not give a right to a refund, as long as the character and quality level of the workshop remain broadly the same.
6. Preferably book travel and accommodation only after final confirmation. Travel and accommodation costs you book yourself, childcare, missed assignments and other consequential costs are not reimbursed. Here too, cancellation insurance can offer a solution.

Section 04 Participation, Safety and Respect

1. You follow reasonable instructions from Wild Heart Tales and treat the models, suppliers, other image makers, bystanders, location and nature with respect.
2. A model is not touched without consent. Clothing, hair, accessories and personal belongings are only adjusted or moved with consent.
3. You stay within permitted areas and follow the rules of the location or nature reserve.
4. In the event of unsafe, discriminatory, intimidating or sexually inappropriate behaviour, your participation can be ended immediately. In the event of less serious disruptive behaviour you will first receive a warning. The decision rests with Wild Heart Tales. If participation is ended there is no refund and you arrange your own transport. Images you have made up to that point may be used under sections 05 and 06.
5. You are responsible for your own equipment, personal belongings, transport and insurance. Liability and equipment insurance is recommended.
6. Damage you culpably cause to the location, to equipment or to the property of others is at your own expense.
7. The workshop is a creative and educational experience. Specific weather, light, bloom, poses, images or portfolio results cannot be guaranteed.

Section 05 What You May Do With Your Images

You create your own work during the workshop; the copyright stays with you. Images means photos, videos and recognisable behind-the-scenes footage you make within the agreed workshop setting.

1. Use for your own website, blog, portfolio and social media.
2. Use in printed portfolios, sample albums and your own professional promotion, online and offline.
3. When publishing, credit Wild Heart Tales, the models and the suppliers involved. On social media you do that with a name mention or tag in the caption, in print with a credit line. You will receive the credit list no later than one week after the workshop.
4. Wild Heart Tales makes sure the models give written consent in advance for the use of their portrait as described above, and arranges consent from the location where needed. If a model later withdraws that consent or objects to a particular publication, we will let you know as soon as possible and look together at what that means for future use. Images that have already been published or printed do not have to be removed, unless this is legally required.
5. Some locations and nature reserves set their own conditions for commercial use. If that applies to a workshop, we will let you know in advance.

Section 06 What You May Not Do With Your Images

These agreements protect the models, the suppliers and the whole team that worked on the shoot.

1. Sale, sublicensing, stock use or transfer to companies or brands that were not involved in the shoot.
2. Entry into contests, awards, photo competitions or jury assessments. Many contests ask for exclusivity or rights to the image, and a single entry can block the chances of the whole team.
3. Publication by magazines, blogs or other editorial media without prior written consent from Wild Heart Tales. Do ask: we are happy to cooperate with publication and will then also arrange consent from the models and suppliers.
4. Use in a political, medical, sexual, degrading, discriminatory or misleading context.
5. Presenting the work as a real wedding, or as a styled shoot you produced entirely yourself.
6. Use as input for generative AI to create new, altered or moving images of a model, such as AI videos, animations, face swaps or changes to face, body, clothing or surroundings. You also do not knowingly supply the images for training AI models. Usual post-processing and AI tools for selection, noise reduction, sharpening, colour work, cropping and removing small blemishes remain permitted, as long as the recognisable appearance of the model does not change and no new or moving image is created.

Section 07 Sharing Images After the Workshop

1. It is lovely if you share at least five edited images with Wild Heart Tales, the models and the suppliers involved within eight weeks. This is a request and not a condition of participation; RAW files do not have to be supplied.
2. If you share images, you give Wild Heart Tales, the models depicted and the suppliers on the credit list the right to use those images free of charge and non-exclusively for their own portfolio, website, social media and promotion of the workshop or their own contribution. Your name will be credited wherever the platform allows.
3. You can end this usage right in writing at any time for new use. Images that have already been published or printed do not have to be removed.
4. Wild Heart Tales, the models and the suppliers do not sell your images, do not sublicense them, do not enter them in contests and do not transfer them to companies or brands that were not involved in the shoot.
5. If you publish images on social media yourself, Wild Heart Tales, the models and the suppliers may share or repost those posts with a credit. If you would rather they did not, just let us know.

Section 08 Incorrect Image Use and Putting It Right

1. If you use images contrary to section 05 or 06, we will first ask you in writing to stop the use, remove it or withdraw an entry within seven days. If you do, the mistake has no further consequences.
2. If you demonstrably cooperate but a use can no longer actually be undone, for example because a magazine has already been printed, no penalty is due either.
3. If you do not stop the use and do not respond to our written notice, a penalty of €250 per unauthorised use is due, up to a maximum of €750 per participant per workshop. This penalty replaces damages.

Section 09 Behind the Scenes, Privacy and Communication

1. On the registration form you indicate separately whether recognisable behind-the-scenes photos and videos of you may be used for promotion. This choice has no effect on your participation and you can withdraw your consent at any time via hello@wildhearttales.com. We will then not use the images again; material that has already been printed or published cannot always be retrieved.
2. Please also respect the choice of other participants: do not publish recognisable images of a fellow participant without their consent.
3. Your personal data is used for registration, payment, invoicing and communication about the workshop. You have the right to access, correct, delete and object to the use of your data, and you can lodge a complaint with the Dutch Data Protection Authority. Which data we keep and for how long is set out in the privacy statement.
4. A temporary WhatsApp group is only used if you choose it and solely for practical information about that workshop. In the group your phone number and profile name are visible to the other participants. The group is deleted no later than two weeks after the workshop.

Section 10 Liability, Complaints and Applicable Law

1. Wild Heart Tales is not liable for loss, theft or damage to equipment and personal belongings, except in the case of intent or deliberate recklessness.
2. As far as legally permitted, liability is limited to the amount you paid for the workshop. This limitation does not apply in the event of death or personal injury. Indirect damage, such as missed assignments or travel and accommodation costs, is not reimbursed.
3. The workshop is a leisure service performed on a date agreed in advance. The statutory fourteen-day right of withdrawal for distance contracts therefore does not apply (article 6:230p under e of the Dutch Civil Code).
4. If you have a complaint, please let us know as soon as possible, and no later than two months after the workshop, in writing at hello@wildhearttales.com. You will receive a substantive response within fourteen days, so we can reach a solution together.
5. If a provision of these terms is void or voidable, the remaining provisions continue to apply and we will replace that provision with a valid one that stays as close as possible to its intent.
6. Dutch law applies to registration and participation. We will first discuss any dispute together; if that does not work, it will be submitted to the competent Dutch court. If you live as a private individual in another EU country, you retain the protection of the mandatory law of your own country. Rights that cannot legally be excluded always continue to apply.
